SERVICE AGREEMENT AND MODEL RELEASE

5. Delivery of Media
Delivery Method: Media will be delivered digitally via an online gallery or by USB.

6. Ownership of Media and Usage Rights
Copyright: All images and footage remain the property of Adventuring Duo.

Model Release: The Client grants Adventuring Duo the right to use, publish, and display images and video for promotional purposes, including on the website, social media, and marketing materials. The Client acknowledges that no additional compensation will be provided for this usage.
7. Model Release Agreement
The Client, and all persons participating in the photography/videography, agree as follows:
"I hereby grant to Adventuring Duo and their legal representatives the irrevocable and unrestricted right to use and publish photographs and videos of me, or in which I may be included, for editorial, trade, advertising, social media, and other purposes. I release Adventuring Duo and its representatives from any liability connected to the publication or usage of these images or videos. I acknowledge that no further payment, royalties, or compensation is due to me for the use of these materials."
8. Drone Services
FAA Compliance: All drone services will comply with FAA regulations, and Adventuring Duo holds a valid FAA license to operate drones commercially.
Weather and Safety: Drone operations are weather-dependent, and Adventuring Duo reserves the right to reschedule or modify services due to unsafe flying conditions.
Client Permissions: The Client is responsible for securing necessary permissions or permits for drone operations on private or public property.
9. Liability and Insurance
Limitation of Liability: Adventuring Duo’s liability for any damages, including but not limited to loss of digital files, is limited to the total cost of the services provided. Adventuring Duo is not liable for any incidental or consequential damages.
Indemnification: The Client agrees to indemnify and hold Adventuring Duo harmless from any claims, damages, or expenses arising from the event or the use of the images or footage.
Insurance: Adventuring Duo holds general liability and drone insurance and will provide documentation upon request.
10. Client Responsibilities
Cooperation: The Client agrees to cooperate with Adventuring Duo to facilitate the execution of the services, including being on time, providing accurate information, and granting access to necessary locations.
Permits and Permissions: The Client is responsible for obtaining any required permits or permissions for the event or location.
11. Dispute Resolution
Governing Law: This agreement is governed by the laws of the state of Washington.
Dispute Resolution: Any disputes arising from this agreement shall first be attempted to be resolved through mediation. If mediation is unsuccessful, the matter shall be settled in the courts of [County], Washington.
12. Entire Agreement
This agreement constitutes the entire understanding between the Client and Adventuring Duo. Any modifications or amendments must be made in writing and signed by both parties.

CONTRACT SCOPE

Copyright and Licensing: Clearly state that Adventuring Duo retains copyright to all images and footage but grants the client a personal, non-commercial license to use the media.
Usage Rights: Specify how the client can use the images (e.g., personal use, sharing on social media) and if additional fees apply for commercial use.
Model Releases: If individuals are being photographed or recorded, include a clause granting permission to use their likeness in the media for promotional purposes (if applicable).

Limitation of Liability: Define the limits of Adventuring Duo’s liability, such as equipment failure or unavoidable accidents.
Indemnification: Include a clause where the client agrees to indemnify Adventuring Duo from any third-party claims or damages arising from the shoot (e.g., injuries or damages caused during the event).
Insurance: State that Adventuring Duo holds liability insurance and, if applicable, drone insurance.
11. Client Responsibilities
Cooperation: Outline the client’s responsibilities, such as providing timely information, punctuality, and giving access to the necessary locations.
Permits and Permissions: Specify if the client is responsible for obtaining permits for drone use, shooting locations, or events.
12. Dispute Resolution
Governing Law: Specify that the contract is governed by the laws of the state of Washington.
Mediation/Arbitration: Include a clause on how disputes will be resolved (e.g., mediation before legal action).

How to Start:
Create a Document: Sign up for HelloSign and upload your contract template. Set up the signature fields and other relevant fields for your clients to fill out.
Generate a Link: HelloSign allows you to generate a signing link for the document. This is done through their “Request Signature” feature where you can create a link that can be shared with clients.
Embed on Squarespace: Once the signing link is generated, you can add this link to your Squarespace site using a button or text block. You can also use the "Code Block" to embed a custom HTML link.
Automation Option: Alternatively, you can send the contract directly via email to your client after they submit a form on your Squarespace site.
Tools Needed: HelloSign account, Squarespace (no additional plugins required).
2. DocuSign Integration with Squarespace
How to Start:
Create a Document: Sign up for DocuSign, upload your contract template, and set up the signature fields.
Create a Signing Link: Like HelloSign, DocuSign allows you to create a signing URL that you can share with clients.
Embed on Squarespace: You can embed the link or provide a button on your Squarespace page where clients can click to review and sign the document.
Send via Email: Similar to HelloSign, you can also send contracts via email once your client submits a form through your Squarespace site.
Tools Needed: DocuSign account, Squarespace (no additional plugins required).
How to Embed or Link the Signing URLs on Squarespace:
Using a Button Block: You can add a "Button Block" to your Squarespace page and link it to the HelloSign or DocuSign signing link.
In the block settings, simply insert the URL to your contract.
Using a Code Block: If you prefer more control or need to embed HTML, you can use the "Code Block" to insert custom HTML that links to your document signing URL.
Automate via Form Submission: You can create a form on your site (e.g., for clients to provide their name and email). Once they submit, you can send them the document for signature using an automatic response email that includes the signing link.
